TERMS & CONDITIONS

PAYMENT TERMS:
Payment is due according to the terms stated on the sales order and invoice. Interest will be assessed for past due invoices. Prices shown will remain firm through delivery, unless otherwise stated in writing. Pricing will be subject to review if the final bill of material is altered from the quoted items and quantities.

DELIVERY:
The deliveries quoted are those at the time of quotation. Tubing Central is not responsible for any changes in delivery beyond our control. Stock is subject to prior sale. Please allow up to 2 business days for pickup of stock orders. Delivery time for custom stick cutting and custom coil lengths are based on workload at the time of order and will be confirmed on the sales order. Business days do not include Saturday, Sunday, or any major US holiday.

SHIPPING CHARGES:
All shipments are EXW-Tubing Central, unless otherwise specified. When prepay and add is required, shipping charges will be passed directly to the purchaser. For pay in advance customers, the shipping charges will be charged automatically as a separate charge when the goods are delivered, unless otherwise requested.

CANCELLATION & RETURNS:
All custom made items and cut to length items are non-cancellable and non-returnable. All quoted items from stock may be returned within 60 days of order, but all shipping charges must be covered by the client and a restocking fee of 25% of the order value will be charged to the client. All claims for discrepancies must be made within 72 hours of receipt of goods. If claim is not made in writing within 72 hours of receipt, all claims are deemed waived and purchaser accepts goods. The goods must be available to be inspected in their original, unaltered condition for a claim to be valid. If any goods have been altered (cut, coated, or otherwise altered), all claims are deemed waived and the purchaser accepts goods.

STICK CUTTING:
Tubing Central provides stick cutting services with a standard length tolerance of +/-0.250″. Cut pieces meeting this tolerance cannot be returned or replaced. If tighter tolerances are required, this must be specified before order and agreed to by Tubing Central.

COIL CUTTING:
Tubing Central provides cut to length coil tubing with a standard length tolerance of +/-10% of the total length. Cut pieces meeting this tolerance cannot be returned or replaced. If tighter tolerances are required, this must be specified before order and agreed to by Tubing Central.

TAXES:
An amount equal to any tax or other governmental charge upon the production, sale, occupation of selling, shipment, storage or use of material, which is now, or may be hereafter, imposed by governmental authorities upon either Purchaser or Seller and which Seller is obligated to pay or collect, shall be added, to the extent attributable to the goods to be sold hereunder, to the price quoted herein and shall be paid by Purchaser.

CONTINGENCIES:
Contracts and shipments are subject to strikes, acts of God, accidents, machinery breakdown, delays of carriers or suppliers, governmental acts, or any other cause, similar or dissimilar, beyond Seller´s reasonable control. Seller may, during period of shortage however caused and without liability, prorate its goods among its customers in such manner as Seller may deem fair and practicable.

DIVERSION CLAUSE:
All shipments hereunder shall at all times be subject to the export control laws and regulations of the U.S.A. and any amendments thereof. Buyer agrees that it shall not make any disposition of U.S.A. origin products purchased from seller by way of trans-shipment, re-export, diversion or otherwise other than in and to the ultimate country of destination specified on buyers order or declared as the country of ultimate destination on seller’s invoices except as said laws and regulations may expressly permit.

INSURANCE:
Unless otherwise requested and/or specified, the purchaser will be responsible for insurance coverage.

WITHDRAWAL:
Tubing Central reserves the right to withdraw subject quotation without obligations. There are no other valid understandings or agreements beyond the quotation unless specifically agreed upon by all parties concerned.

RESTRICTIONS:
Tubing Central will not be able to furnish the equipment if the end destination of the equipment quoted is intended for use in the following countries: N. Korea, Cuba, and Iran. Some countries may have restrictions on certain types of equipment which is determined by U.S. Regulations. If so, we will not be able to furnish this equipment. These countries are: Angola, Colombia, Democratic Republic of the Congo, Lebanon, Liberia, Rwanda, Somalia, Sudan, Syria.
